The client remains responsible for providing accurate information regarding the property and requirements.

07

Design Services

Where design services are engaged, the exact scope of design services will be defined in the applicable design proposal or agreement.

Depending on the selected package, design services may include:

  • Requirement understanding
  • Space planning
  • 2D layouts
  • Furniture layouts
  • Interior elevations
  • 3D views
  • Material and finish selection
  • Design development

  • Design documentation
  • Re-quotation based on approved design
  • Other services specifically mentioned in the proposal

The exact number and nature of drawings, 3D views, revisions, selections and deliverables shall be as specified in the applicable proposal.

08

Design Development And Revisions

Interior design is developed through a process of understanding requirements, preparing proposals, reviewing them and obtaining client approvals.

The client is expected to provide timely feedback and decisions.

Design changes requested after approval may:

  • Require additional design work
  • Affect quantities
  • Affect pricing
  • Affect procurement
  • Affect execution sequence
  • Affect project timelines
  • Require new drawings or revised documentation

Where changes are outside the agreed design scope, Meraghar Interiors may charge additional fees or revise the project quotation.

Once a design, drawing, material or finish has been approved and procurement or execution has commenced, changes may result in additional costs.

09

Measurements And Site Conditions

Interior design and execution depend significantly on actual site conditions.

Dimensions shown in preliminary discussions, website examples, calculators or initial estimates may not represent the final site dimensions.

Final dimensions may be affected by:

  • Actual wall dimensions
  • Beam and column positions
  • Plumbing points
  • Electrical points
  • Existing furniture
  • Flooring levels
  • Ceiling levels
  • Window positions
  • Door positions
  • Uneven walls
  • Civil work
  • Structural conditions
  • Building services
  • Other site conditions

Final fabrication and execution shall be based on applicable approved measurements and execution drawings.

Meraghar Interiors shall not be responsible for inaccuracies resulting from incorrect information, measurements or site conditions supplied by third parties or existing at the property.

10

Existing Property Conditions

Existing properties may contain concealed or unforeseen conditions that cannot reasonably be identified before dismantling or opening existing structures.

Examples may include:

  • Concealed electrical wiring
  • Concealed plumbing
  • Leakage
  • Dampness
  • Uneven walls
  • Structural irregularities
  • Weak substrates
  • Existing termite damage
  • Damaged flooring
  • Concealed services
  • Inadequate electrical capacity
  • Existing civil defects

Where such conditions are discovered, the required corrective work may fall outside the original scope.

Any additional work or associated cost shall be discussed with the client and, wherever reasonably possible, approved before execution.

11

Quotations And Estimates

Any price displayed on the website, social media, calculator, advertisement, brochure or other general communication may be indicative unless expressly identified as a final quotation.

An actual project quotation is prepared based on factors such as:

  • Property size
  • Design requirements
  • Number and size of rooms
  • Scope of work
  • Quantities
  • Materials
  • Finishes
  • Hardware
  • Accessories
  • Site conditions
  • Design requirements
  • Execution requirements
  • Client selections
  • Applicable taxes
  • Other project-specific factors

The final project price shall be the amount stated in the accepted quotation or agreement.

A website calculator or indicative budget estimate is not a substitute for a detailed quotation.

12

Quotation Validity

Where a quotation contains a validity period, the quotation shall remain valid only for that stated period unless extended by Meraghar Interiors in writing.

Material prices, labour costs, vendor prices, transportation costs and other project costs may change over time.

A quotation that has expired may need to be revised before the project is confirmed.

13

Taxes And Gst

Prices communicated by Meraghar Interiors shall clearly indicate, wherever applicable, whether taxes are included or excluded.

Applicable taxes, including Goods and Services Tax (GST), shall be charged as required under applicable law and according to the nature of the transaction and service.

Where a quotation specifically states that GST is additional, the applicable GST shall be payable in addition to the quoted amount.

The client's decision regarding whether a GST invoice is required does not alter Meraghar Interiors' legal tax obligations.

14

Payments

Project payments shall be made according to the payment schedule specified in the accepted quotation, proposal or agreement.

Depending on the project, payments may be linked to:

  • Design initiation
  • Project commencement
  • Site start
  • Procurement
  • Carcass or plywood procurement
  • Manufacturing
  • Laminate or finish procurement
  • Installation
  • Completion
  • Handover
  • Additional work

The exact payment schedule shall be project-specific.

Where payment is required before procurement, manufacturing or commencement of a particular activity, that activity may be scheduled only after the applicable payment has been received.

15

Delayed Payments

Timely payments are necessary for maintaining procurement and execution schedules.

A delay in payment may result in:

  • Delay in procurement
  • Delay in manufacturing
  • Delay in installation
  • Delay in vendor scheduling
  • Change in material availability
  • Change in material pricing
  • Extension of project timeline

Where a project is delayed due to non-payment or delayed approval by the client, the resulting delay may not be attributable to Meraghar Interiors.

Any applicable interest, charges or other consequences of delayed payment shall be governed by the project-specific agreement.

16

Additional Work And Change Requests

Interior projects frequently involve changes after the original scope has been approved.

Additional work may include:

  • Additional furniture
  • Additional storage
  • Additional electrical points
  • Additional lights
  • Additional carpentry
  • Additional false ceiling
  • Additional painting
  • Additional civil work
  • Additional hardware
  • Additional accessories
  • Changes in material
  • Changes in laminate or finish
  • Changes in dimensions
  • Changes in design
  • Additional appliances or fittings
  • Work requested after commencement

Additional work shall not automatically be considered part of the original quotation.

Where applicable, additional work shall be separately estimated and approved before execution.

Meraghar Interiors may require advance payment for additional work depending on the value and nature of the work.

17

Scope Of Work

Only items expressly included in the accepted quotation, BOQ, proposal or agreement shall be treated as included in the project.

Items not mentioned in the agreed scope shall not automatically be considered included merely because they are:

  • Commonly expected in an interior project
  • Visible in reference images
  • Shown in inspiration images
  • Mentioned verbally during discussions
  • Present in a 3D visual unless specifically included
  • Required as a consequence of a later client change

The client is encouraged to review the scope, quantities, specifications and exclusions before approving the project.

The exact exclusions shall always be determined by the applicable project quotation or agreement.

  • Electrical products
  • Lighting
  • False ceiling materials
  • Other interior materials

The material specification applicable to a particular project shall be as stated in the approved quotation, BOQ, material sheet or project agreement.

A general material description on the website does not automatically mean that the material is included in every project.

20

Product And Material Variations

Natural and manufactured materials may show variations in:

  • Colour
  • Shade
  • Grain
  • Texture
  • Pattern
  • Gloss level
  • Surface appearance
  • Batch characteristics

Such variations do not necessarily constitute a defect.

Samples, photographs and digital representations may not exactly reproduce the final appearance of a material under different lighting conditions.

Where a specific product or brand has been approved, availability may depend on the manufacturer, distributor and market conditions.

If an approved product becomes unavailable, discontinued or materially delayed, Meraghar Interiors may propose an alternative of comparable specification, subject to client approval where applicable.

21

Hardware And Manufacturer Warranties

Where branded hardware, electrical products, appliances, accessories or other third-party products are used, the applicable manufacturer's warranty shall apply.

Manufacturer warranties may have conditions relating to:

  • Installation
  • Usage
  • Maintenance
  • Product registration
  • Misuse
  • Physical damage
  • Normal wear and tear
  • Water exposure
  • Electrical conditions
  • Unauthorized modification

Meraghar Interiors shall assist with service coordination where such assistance is included in the project/service arrangement, but manufacturer warranty decisions remain subject to the manufacturer's terms.

22

Workmanship Warranty

Where a workmanship warranty is offered, the duration and scope shall be stated in the applicable project documents.

A workmanship warranty may cover defects attributable to workmanship within the specified warranty period, subject to the terms of the project agreement.

The warranty generally does not extend to:

  • Normal wear and tear
  • Misuse
  • Accidental damage
  • Damage caused by third parties
  • Water leakage
  • Civil or structural movement
  • Building defects
  • Pest or termite infestation caused by external conditions
  • Unauthorized modifications
  • Client alterations
  • Damage caused by external contractors
  • Improper maintenance
  • Manufacturer defects covered by the manufacturer's warranty

The specific warranty terms provided with the project shall prevail.

23

Civil, Structural And Building-Related Issues

Unless specifically included in the project scope, Meraghar Interiors does not assume responsibility for the structural integrity of the building or for pre-existing civil defects.

Examples include:

  • Structural cracks
  • Slab defects
  • Structural movement
  • Major leakage
  • Waterproofing failure
  • Building plumbing issues
  • Society infrastructure
  • Main electrical supply
  • External drainage

  • Existing construction defects

Where such issues affect the interior work, the project timeline and cost may be affected.

24

Client Responsibilities

The client is responsible for:

Taking reasonable care of completed work after handover.

Failure to fulfil these responsibilities may affect project cost, schedule or execution.

25

Site Access

The client shall provide reasonable access to the property during agreed working hours.

Site access may be subject to:

  • Society rules
  • Building working hours
  • Security restrictions
  • Lift availability
  • Parking availability
  • Material movement restrictions
  • Permissions
  • Noise restrictions
  • Other building regulations

Meraghar Interiors shall comply with reasonable building and society requirements communicated to it.

Delays caused by restrictions outside Meraghar Interiors' reasonable control may affect the project timeline.

26

Society And Building Permissions

Where required, permissions from housing societies, developers, building management, municipal authorities or other authorities may be necessary.

Unless specifically included in the agreed scope, the client shall be responsible for obtaining permissions that are legally or contractually the client's responsibility.

Any society deposits, permissions, penalties, working-hour restrictions, lift charges or similar charges shall be handled according to the agreed project scope.

27

Project Timelines

Meraghar Interiors may provide estimated project timelines based on the scope and conditions known at the time of planning.

A timeline may depend upon:

  • Design approvals
  • Site readiness
  • Civil completion
  • Measurements
  • Material selections
  • Client approvals
  • Payments
  • Procurement
  • Manufacturing
  • Material availability
  • Vendor availability
  • Society working hours
  • Site access
  • Additional work
  • Changes requested by the client

Therefore, a stated timeline should be understood as an estimated project schedule rather than an unconditional guarantee of completion on a particular calendar date, unless expressly agreed otherwise in writing.

Meraghar Interiors shall not be responsible for delays caused by circumstances reasonably outside its control.

These may include:

  • Natural disasters

  • Designs
  • 3D views
  • Materials
  • Colours
  • Laminates
  • Hardware
  • Electrical points
  • Lighting
  • Furniture
  • Dimensions
  • Additional work
  • Changes
  • Other project decisions

The client is responsible for reviewing approvals carefully.

Once an item has been approved and procurement, manufacturing or execution has commenced, changes may involve additional cost and/or delay.

Where approvals are communicated electronically, including through email, messaging platforms or other agreed communication channels, such approval may be treated as project approval subject to applicable law and the project agreement.

30

Digital Communication

Meraghar Interiors may communicate with clients through:

  • Email
  • Telephone
  • WhatsApp
  • Other messaging platforms
  • Project management systems
  • Digital documents
  • Other mutually accepted communication channels

Clients should retain important approvals, payment records and project communications for their records.

Where a project agreement specifies an official communication channel, that channel shall take precedence for formal project communications.

31

Interior Calculator And Online Estimates

The Meraghar Interiors website may provide an interior cost calculator or budget estimation tool.

Such calculators are intended only to provide an indicative understanding of possible project costs.

The actual cost of an interior project may vary substantially based on:

  • Scope
  • Dimensions
  • Material selection
  • Hardware
  • Finishes
  • Quantity
  • Site conditions
  • Design requirements
  • Brand selection
  • Labour
  • Civil work
  • Electrical work
  • Client changes
  • Applicable taxes

The website may contain:

  • Completed project photographs
  • Work-in-progress photographs

Actual results may differ due to:

  • Site dimensions
  • Lighting
  • Camera conditions
  • Material batch
  • Client selections
  • Changes in design
  • Manufacturing limitations
  • Site conditions

A photograph or render shall not by itself be interpreted as a guarantee that an identical result, product, finish or specification will be provided in another project.

33

Design Renders And Actual Execution

3D visualisations are intended to communicate design intent.

Certain elements may appear differently in the final executed project due to:

  • Actual material availability
  • Manufacturing limitations
  • Site dimensions
  • Lighting
  • Structural conditions
  • Product specifications
  • Safety requirements
  • Technical requirements
  • Client-approved changes

Where a difference is necessary for technical, safety or execution reasons, Meraghar Interiors may propose a suitable alternative.

Unless otherwise agreed in writing, design concepts, drawings, layouts, 3D visuals, documentation and other creative work developed by Meraghar Interiors shall not be reproduced, transferred to another designer, contractor or third party for execution without the applicable rights or permission.

Payment for a design service does not automatically transfer all intellectual property rights in the underlying creative work unless the applicable agreement expressly provides otherwise.

Meraghar Interiors may wish to photograph or record completed projects for purposes such as:

  • Portfolio presentation
  • Website
  • Social media

Mention of a third-party brand on the website does not necessarily mean:

The brand is included in every project.

The product is currently available.

The product is endorsed by the manufacturer.

The manufacturer has entered into a partnership with Meraghar Interiors.

Third-party products remain subject to the manufacturer's specifications, availability and warranty conditions.

Meraghar Interiors encourages clients to raise project concerns promptly so that reasonable corrective action can be considered.

A complaint may relate to:

  • Workmanship
  • Material
  • Installation
  • Design
  • Project coordination
  • Service
  • Warranty
  • Post-handover issue

Where applicable, the client should provide sufficient information, photographs, videos, invoices, project references or other details necessary to assess the concern.

Meraghar Interiors may inspect the issue before determining the appropriate corrective action.

Where the issue relates to a manufacturer product, the manufacturer warranty process may also apply.

Nothing in these Terms is intended to restrict any statutory rights available to a consumer under applicable law. The Consumer Protection Act, 2019 provides a statutory framework for consumer complaints and consumer redressal.

The company may request:

  • Project details
  • Description of the issue
  • Photographs
  • Videos
  • Date of occurrence
  • Relevant product information

A service request does not automatically mean that the issue is covered under warranty.

The issue may first need to be inspected and classified as:

  • Workmanship issue
  • Manufacturer/product issue
  • Normal wear and tear
  • Client-use issue
  • External damage
  • Civil/building issue
  • Maintenance issue
  • Out-of-warranty issue
47

For an actual project, clients should rely on the applicable written proposal, quotation, BOQ and agreement.

48

Limitation Of Liability

To the extent permitted by applicable law, Meraghar Interiors shall not be liable for indirect, incidental or consequential losses arising solely from the use of general website information.

Nothing in these Terms shall be interpreted as excluding or limiting liability that cannot lawfully be excluded or limited under applicable law.

Nothing in these Terms is intended to exclude statutory consumer rights or remedies available under applicable law.

Project-specific liability, warranty and responsibility shall be governed by the applicable project agreement, subject to applicable law.

49

  • Strikes
  • Epidemics or pandemics
  • Major transport disruption
  • Supply-chain disruption
  • Manufacturer shutdown
  • Significant material shortages
  • Building restrictions
  • Utility failure
  • Other events beyond reasonable control

The affected obligations and timelines may be reasonably adjusted to account for the circumstances.

50

Termination Of A Project

Termination or cancellation of a project shall be governed primarily by the applicable project agreement or quotation.

Depending on the stage of the project, amounts may already have been committed towards:

  • Design work
  • Vendor bookings
  • Materials
  • Manufacturing
  • Labour
  • Transportation
  • Site work
  • Custom products
  • Other project expenses

Accordingly, the financial consequences of cancellation may vary depending upon the stage of the project and the applicable project agreement.

Any refund, adjustment or outstanding payment shall be determined according to the agreed project terms and applicable law.

51

No Automatic Refund

Payment for a particular service, design stage, material, procurement or completed work does not automatically create a right to refund merely because the client subsequently changes their mind.

Refunds, cancellations and adjustments shall be considered according to:

  • The applicable project agreement
  • Stage of work
  • Work already completed
  • Materials already purchased
  • Vendor commitments
  • Custom manufacturing
  • Applicable taxes
  • Applicable law

Where a statutory right to refund or other remedy exists, nothing in these Terms is intended to restrict that right.

52

Client-Supplied Materials Or Products

Where a client chooses to supply materials, appliances, fittings, hardware or other products directly, the client shall generally remain responsible for:

  • Product selection
  • Product availability
  • Delivery
  • Manufacturer warranty
  • Product compatibility
  • Missing components
  • Product defects

Installation of client-supplied products, where agreed, may be subject to additional conditions.

Meraghar Interiors shall not be responsible for defects inherent in client-supplied products.

53

Appliances And Specialised Products

Where appliances or specialised products are incorporated into the design, the client shall provide accurate product specifications and model details where required.

Changes in appliance model or dimensions after design approval may affect:

  • Cabinet dimensions
  • Electrical requirements
  • Plumbing requirements
  • Ventilation
  • Countertop requirements
  • Storage
  • Design
  • Cost
  • Installation

Any resulting modifications may be treated as additional work.

54

Electrical, Plumbing And Other Services

Electrical, plumbing and allied services shall be performed only to the extent included in the agreed project scope.

Existing electrical capacity, wiring, plumbing infrastructure and building services may impose limitations.

Additional work required because of existing site conditions, building requirements or client changes may be charged separately where outside the agreed scope.

Final technical requirements shall be determined based on the applicable project drawings, specifications and site conditions.

55

Safety And Site Conditions

Meraghar Interiors will take reasonable steps to coordinate work safely within the scope of its responsibilities.

However, construction and interior work inherently involves site-related risks.

The client should not enter active work areas without appropriate care and should follow building, site and safety instructions.

Children, pets and unauthorised persons should be kept away from active work areas where appropriate.

56

Household Items And Client Property

Before execution begins, clients should remove or secure valuable, fragile or personal items that are not part of the agreed work.

Where existing furniture, electronics, appliances or personal belongings remain at the site, Meraghar Interiors shall take reasonable care during its work; however, it cannot guarantee protection against every accidental event or condition beyond its reasonable control.

57

Natural Wear And Maintenance

Interior products require appropriate care and maintenance.

Normal wear and tear may occur over time due to:

  • Regular use
  • Cleaning
  • Moisture
  • Heat
  • Sunlight
  • Friction
  • Impact
  • Chemical exposure
  • Heavy usage

Such deterioration may not constitute a workmanship defect.

Clients should follow the applicable manufacturer's or Meraghar Interiors' maintenance recommendations.

58

Colours And Digital Representation

Colours displayed on screens may vary depending on:

  • Device
  • Display settings
  • Lighting
  • Photography
  • Image processing

Accordingly, digital representations should not be treated as an exact representation of a physical material.

Where important, physical samples should be reviewed before final approval.

59

This may include:

  • Services
  • Prices
  • Articles
  • Images
  • Calculator assumptions
  • Design examples
  • Offers
  • Contact methods
  • Website features

Such changes will not automatically alter the terms of an already accepted project agreement.

60

Promotional offers displayed on the website or through advertising channels may be subject to specific conditions.

Unless otherwise stated:

Offers may have limited validity.

Offers may apply only to specified services.

Offers may not be combined with other offers.

Offers may be subject to project eligibility.

Meraghar Interiors may discontinue an offer after its stated validity period.

The specific terms attached to an offer shall govern that offer.

61

No Guarantee Of Project Acceptance

Submitting a website enquiry, visiting the office, requesting a quotation or attending a consultation does not guarantee that Meraghar Interiors will undertake the project.

Meraghar Interiors may assess the project based on factors including:

  • Location
  • Scope
  • Budget
  • Timeline
  • Project suitability
  • Availability
  • Site conditions
  • Service requirements

The final decision to undertake a project shall be subject to mutual agreement.

62

  • Structural engineers
  • Architects
  • Electrical engineers
  • Plumbing engineers

Where specialist certification, approval or technical design is required, the appropriate professional or authority may need to be engaged.

63

No Assurance From Reference Projects

Past projects displayed by Meraghar Interiors demonstrate previous work and are provided as references.

Past project results do not guarantee that every future project will have:

  • The same cost
  • The same timeline
  • The same materials
  • The same workmanship conditions
  • The same design
  • The same site conditions
  • The same vendors
  • The same final appearance

Every project is individually assessed.

64

Meraghar Interiors primarily operates in Pune and PCMC and may accept projects in other locations depending on project requirements, feasibility and availability.

Additional travel, logistics or other costs may apply to projects outside the normal service area where agreed.

Confidentiality

Meraghar Interiors and the client may exchange project-related information during the course of a project.

Where a separate confidentiality agreement exists, that agreement shall govern confidential information.

Subject to applicable law and the jurisdiction available to consumers under applicable legislation, matters relating to these Terms and the services provided by Meraghar Interiors shall be subject to the appropriate courts and authorities having jurisdiction in Maharashtra.

Nothing in this clause is intended to take away any statutory jurisdiction or remedy available to a consumer under applicable law.

67

Dispute Resolution

Meraghar Interiors encourages clients to first raise any concern directly with the company so that the matter can be reviewed and reasonably resolved.

Where appropriate, the parties may mutually consider discussion, negotiation or mediation before pursuing formal proceedings.

Nothing in this section prevents a consumer from exercising any statutory rights or remedies available under applicable law.

The Consumer Protection Act, 2019 provides mechanisms for consumer dispute redressal, including District, State and National Consumer Commissions.

68

Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall be interpreted or modified to the extent necessary to make it legally valid, where possible.

The remaining provisions shall continue to remain effective.

69

Waiver

Failure by Meraghar Interiors to enforce any provision of these Terms on one occasion shall not be treated as a waiver of its right to enforce that provision in the future.

70

Entire Understanding For Website Use

These Terms & Conditions, together with the Privacy Policy and any other website policies specifically referenced on the website, constitute the general terms governing use of the Meraghar Interiors website.

For an actual project, the accepted project-specific quotation, proposal, BOQ, agreement, work order and related written approvals shall govern the project.

  • Project quotation / proposal → Commercial and scope information
  • Approved drawings / BOQ / specifications → Technical and execution information
  • Project agreement / work order → Contractual project terms

Where there is a conflict between general website information and an accepted project-specific document, the project-specific document shall govern the particular project, subject to applicable law.
